Zweitens geht er der Frage nach, ob und wann ein solcher Strukturwandel zur Konsequenz hätte, dass sich die Sozialformation der Moderne insgesamt transformiert. Im Ergebnis formuliert er die Hypothese, dass sich ein Strukturwandel des Eigentums dahingehend abzeichnet, dass die Verbindungsketten zwischen Eigentum und Besitz immer länger und komplexer werden und sich an vielen Stellen zu lockern beginnen. Dadurch kommt es zur Aufspaltung oder sogar -splitterung der mit dem Eigentum ursprünglich verknüpften (Verfügungs‑)Rechtebündel und der korrespondierenden Sorgepflichten. Sowohl auf dem Feld der gesellschaftlichen Produktion als auch im Konsum von Gütern werden daher das Eigentum an Dingen und die mit ihm verbundenen Verfügungsrechte und Sorgepflichten durch begrenzte Bündel an Zugangs- und Nutzungsrechten ersetzt. Dieser Wandel setzt jedoch die Steigerungsimperative der Kapitalakkumulation und der dynamischen Stabilisierung keineswegs außer Kraft, sondern erweist sich als deren funktionales Erfordernis. Die Basisinstitution der modernen Sozialformation befindet sich in einem tiefgreifenden Wandel; die formationsbestimmenden Prinzipien bleiben indessen, einstweilen wenigstens, ungebrochen in Kraft. Abstract The article starts from the thesis that (private) property represents a culturally and structurally foundational institution of modern societies. It examines firstly whether, in view of the conflicts over cultural assets, genes, patents, data, infrastructures etc. that have spread in recent decades, we can speak of a fundamental structural change of property. Secondly, it examines the question of whether and when such a structural change would have the consequence of transforming the social formation of modernity as a whole. As a result, it poses the hypothesis that a structural change of property can be traced to the fact that the chains of connection between property and ownership are becoming ever longer and more complex and are beginning to loosen in many places. This leads to the splitting—even fragmentation—of the bundles of rights (of disposal) originally associated with property and the corresponding duties of care. Both in the field of social production and in the consumption of goods, the ownership of things and the associated rights of disposal and duties of care are being replaced by limited bundles of rights of access and use. However, this change in no way invalidates the imperatives of capital accumulation and dynamic stabilization; rather, it proves to be their functional requirement. The basic institution of modern social formation is undergoing profound change; yet the principles that determine its formation remain, for the time being at least, very much unbroken.
