Invented back in the sixties, the internet evolved to a mass media phenomenon of the information society and gained economic, political, juristic and social meaning in very short time. The connectivity of the net enables borderless data transfer. New legal issues are exposed and lead to many discussions. Through these immense influences and the ongoing globalizing the former set up structures become blurry. The world must deal with moral, social, economic, political and technical aspects. The original scientific usage did not need any official regulation, the community regulated it self with an unwritten code of behaviour. With its growth new problems arose and the self regulation did not work any more. With the founding of the private US-organisation Internet Corporation for Assigned Names and Numbers (ICANN), the solution seemed to have been found. The Goal of this paper is to work out the phenomenon ICANN. The focus is set on the problems and conflicts caused by the organisation. From a critical view alternative forms of internet regulations are shown. In the following part is examined if ICANN can and should fulfil the duties in the future and on the other hand which mechanisms could be more fitting. The last part is about the power of the USA over the internet and the future of ICANN. The entry consists of common history and technical internet basics, followed by the description of the institution ICANN on hand it is managing and contract structures and duties. It's followed by a critical discussion about ICANN over the pointed basic problems and a summon of some actual specific areas of conflict. The work’s focus includes the structure and organisation of ICANN and the internet. Different kinds of solutions are illustrated and it is gone into historical related and actual and formal legal backgrounds. On them link theories about internet governances. Advantages and disadvantages of self regulation and official management are depicted and ICANN is classified there in. As a result alternative kinds of internet management commencement are shown. The following chapter is dedicated to the extraordinary position of the US in the Internet and the future for ICANN. With a global overview ICANN’s internationality as US-institution is lightened up and the corresponding problems are shown. A short sum forms the end of the work.
Das in den USA der 60er Jahre geborene Internet entwickelte sich in kürzester Zeit zu einem Massenmedienphänomen der Informationsgesellschaft und erlangte wirtschaftliche, politische, rechtliche und soziale Bedeutung. Die Konnektivität des Netzes ermöglicht grenzenlosen Datentransfer. Sie wirft neue juristische Sachverhalte auf und führt zu zahlreichen Grundsatzdiskussionen. Durch seine umfangreichen Wirkungen und die voranschreitende Globalisierung verwischen einst geordnete Strukturen, die Welt muss sich mit moralischen, gesellschaftlichen, ökonomischen, politischen oder technischen Aspekten auseinandersetzen. Die anfangs rein wissenschaftliche Internet-Nutzung bedurfte keiner staatlichen Regelungen, seine Gemeinschaft verwaltete sich allein mittels impliziter Verhaltensregeln. Jedoch entstanden mit der wachsenden Bedeutung zusehends Probleme und die Selbstverwaltung funktionierte kaum noch. Mit der Gründung der privatrechtlichen US-Institution Internet Corporation for Assigned Names and Numbers (ICANN), hoffte man, eine geeignete Lösung gefunden zu haben. Ziel der Arbeit ist es, sich mit dem Phänomen ICANN auseinanderzusetzen. Der Fokus richtet sich auf die durch die Organisation verursachten Problembereiche und Konflikte. Aus der kritischen Betrachtung heraus werden alternative Formen der Internet-Regulierung dargestellt. Anschließend wird untersucht, ob ICANN weiterhin die zu erfüllenden Aufgaben wahrnehmen kann und soll bzw. ob und welche anderen Mechanismen geeigneter sein könnten. Der letzte Teil widmet sich dem Machteinfluss der USA über das Internet und ICANNs Zukunft.
